These terms and conditions govern your access to and use of the Landscape Institute Campus website (https://campus.landscapeinstitute.org/(the “website”).

By accessing and using the website you accept these terms and conditions and agree to comply with them. If you do not agree to these terms and conditions, you must not use the website.

 

1. Who we are and how to contact us

1.1 The website is operated by the Landscape Institute. The Landscape Institute is a registered charity (numbers 1073396 (England & Wales) and SC047057 (Scotland)) and a corporation incorporated by Royal Charter. Our office is at 85 Tottenham Court Road, London W1T 4TQ.

2. Use of the website

2.1 The website is accessible to the public, but access to videos of events is only available to registered users.

 

3. Registered users

3.1 A user of the website can only view or purchase videos of events if you have a MyLI online account. Landscape Institute members and non-members can register for a MyLI account and login via https://my.landscapeinstitute.org/login.

3.2 The right of access to videos of events on the website is personal to users who have a MyLI account (“registered users”) and this access is for the benefit of registered users only, for as long as your purchase or subscription is valid and for as long as we permit such access. You may not share your MyLI account with any other person and you are responsible for preventing unauthorised access to your MyLI account and the videos of events. By holding a MyLI account you accept responsibility for all activities that occur under your account or password. Registered users must notify the Landscape Institute immediately if they are aware of or suspect any unauthorised use of the website and/or the content on the website.

 

4. Accessing events

4.1 There are two types of events available to view on the website:

4.1.1 catchup, which is available to view at any time; and

4.1.2 livestream, which is only available to view during an event and for a short period afterwards, after which the video will be removed from the website.

4.2 Any registered user may access videos of some events without charge. Registered users may only access premium events on the website by paying the required fee or taking out a 12 month subscription.

4.3 Any registered user who has taken out a 12 month subscription may on the expiry of the subscription renew their subscription in accordance with such procedure as the Landscape Institute may specify.

4.4 All purchases can only be made on the website in advance in accordance with the payment procedure on the website.

 

5. Conditions of purchasing access to premium events

5. 1 All purchases must be made by credit / debit cards. Credit / debit cards will be debited at the point of sale.

5. 2 Prices quoted on the website [include VAT] and represent the price that will be charged to the registered user’s credit or debit card at the point of sale.

5.3 A contract between a registered user incorporating these terms and conditions is formed between the Landscape Institute and the registered user at the point of sale and will be confirmed by email to the address supplied through MyLI.

5.4 A purchase of access to a premium event is non-exchangeable, non-transferable and non-refundable, except (where a registered user purchases a single event) where a registered user can prove that a video of the event was wrongly described or incorrectly supplied. It is the responsibility of the registered user to submit a refund claim within 14 days of the point of sale. Refunds will be at the discretion of the Landscape Institute and will be credited to the debit / credit card originally used for the purchase within 14 days.

5.5 Once a video of an event has been made available to a registered user the purchase cannot be cancelled, subject only to clause 5.4.

5.6 Occasionally technical reasons may result in a delay to registered users being able to access videos of events and the Landscape Institute will use all reasonable endeavours to resolve any technical issues as soon as possible.

5.7 The Landscape Institute reserves the right to withdraw access from any registered user that breaches these terms and conditions.

 

6. Discounts

6.1 Any member of the Landscape Institute will receive a discount applied automatically on subscribing for premium events or purchasing a 12 month subscription.

6.2 The Landscape Institute may at its discretion issue discount vouchers to any person which may be applied on the website for subscribing to premium events or purchasing a 12 month subscription.

 

7. Changes to fees

7.1 The Landscape Institute may change any fee for accessing premium events, but will only do so in respect of an existing registered user who has taken out a 12 month subscription with effect from renewal of their subscription, or if the registered user no longer meets the requirements for a reduced fee or a waiver of the fee.

 

8. Keeping your account details safe

8.1 If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose such information to any third party.

8.2 We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms and conditions.

8.3 If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at contact@landscapeinstitute.org.

 

9. Linking to the website

9.1 You may link to the website home page and to specific content (such as videos from an event) in another website or on social media and are encouraged to do so, provided you do so in a way that is fair and legal and does not damage the reputation of the Landscape Institute, or take advantage of it.

9.2 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

9.3 We reserve the right to withdraw linking permission without notice.

9.4 Any website in which you are linking must comply in all respects with our acceptable use standards.

 

10. Breach of these terms and conditions

10.1 If you breach these terms and conditions, the Landscape Institute may take any of the following actions:

      • terminate your use of the website (including any user name or password);
      • issue a warning to you;
      • withdraw your right to use the website (on a temporary or permanent basis);
      • take legal proceedings against you; and
      • disclose information to law enforcement authorities.

10.2 Where you have paid a fee for access to premium events you will not be entitled to a full or partial refund if the Landscape Institute takes any of the actions under paragraph 10.1.

 

11. How we may use your personal information

11.1 We will only use your personal information as set out in our privacy policy (https://landscapeinstitute.org/privacy) which will apply to your use of the website. This sets out the terms on which we process any personal data that you provide to us.

 

12. Cookies

12.1 Our Cookie Policy (https://campus.landscapeinstitute.org/cookie-policy/) sets out information about the cookies on the website.

 

13. Changes to these terms and conditions

13.1 We may amend these terms and conditions from time to time. Please check these terms to ensure you understand the terms and conditions that apply at the time you use the website. These terms were most recently updated on 30 March 2020.

 

14. Changes to the website

14.1 We may update and change the website from time to time. Whilst we will seek to ensure that the website is up to date, we do not guarantee that the website, or any content on it, will be free from errors or omissions.

 

15. Suspension or withdrawal of the website

15.1 We do not guarantee that the website, or any content or functionality on it, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the website, or discontinue any part of the website, without notice. We will not be liable to you if for any reason the website is unavailable at any time or for any period.

 

16. How you may use material on the website

16.1 The Landscape Institute is the owner or the licensee of all intellectual property rights in the design and layout of the website and in the material published on it. This includes, but is not limited to, copyright and rights in registered and unregistered trademarks. The works on the website are protected by copyright laws and all rights are reserved.

16.2 Subject to paragraph 16.3, you may not reproduce, download, transmit or retransmit, manipulate or store on paper or in electronic form any part of the website and the information and material published on it.

16.3 You may print one copy, and may download extracts, of any pages from the website for your personal use and you may draw the attention of others within your organisation to content posted on the website. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. The status of the Landscape Institute (and that of any identified contributors) as the authors of content on the website must always be acknowledged.

16.4 You must not use any part of the content on the website for commercial purposes without obtaining a licence to do so from the Landscape Institute or our licensors.

16.5 If you print off, copy or download any part of the website in breach of these terms of use, your right to use the website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

 

17. Acceptable use

17.1 You may not use the website:

      • in any way that breaches any law or regulation;
      • in any way that is fraudulent, or has any unlawful or fraudulent purpose;
      • to transmit any unsolicited or unauthorised advertising or promotional material (spam);
      • to introduce or transmit knowingly viruses, trojans, worms, or other material that is malicious or technologically harmful; or
      • otherwise in contravention of these terms.

18.1 Where the website contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. The Landscape Institute has no control over the contents of those sites or resources.

 

19. Disclaimer

19.1 The videos and other content on the website is provided for general information and CPD training purposes only. It is not intended to amount to advice on which you should rely. The website and information on it are not intended as a substitute for professional advice or judgement, or to provide legal or other advice in respect to particular circumstances.

19.2 The Landscape Institute makes no representations, warranties or guarantees, whether express or implied, that the videos and other content on the website is accurate, complete or up-to-date. The Landscape Institute accepts no responsibility for use of website, accuracy of information or errors or omissions or misunderstandings arising from it.

19.3 To the extent permitted by law, the Landscape Institute excludes all implied conditions, warranties, representations or other terms that may apply to the website or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

      • use of, or inability to use, the website;
      • use of or reliance on any content displayed on the website; or
      • any loss or damaged caused by a virus or other technologically harmful material due to your use of the website;

In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;

20. General provisions

20.1 The Landscape Institute reserves the right to assign any or all or its rights and obligations under these terms and conditions to any third party.

20.2 These terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
